We consider ensuring the right to the protection of personal data as a fundamental commitment of CN APM SA Constanta, therefore we will dedicate all necessary resources and efforts to process your data in full compliance with Regulation (EU) 2016/679 (“General Data Protection Regulation ”Or“ GDPR ”), as well as with any other legislation applicable on the territory of Romania. As one of the key principles of this legal framework is transparency, this document is intended to inform you about how we collect, use, transfer and protect your personal data when you interact with us about our products and services, including through our website or mobile applications.

We reserve the right to periodically update and modify this Privacy Policy to reflect any changes to the way we process your personal data according to legal requirements. The National Company "Administration of Maritime Ports" S.A. Constanta (CN APM SA) assumes the right to modify / update / correct the structure, content and services at any time or to suspend its temporary operation, without further notice.

When you create an account or use our services, you enter into an agreement with us and accept this Privacy Policy, as well as the Terms and Conditions. Each time you use your account or our services or provide us with information, the processing of your personal data will be governed by the current version of this Privacy Policy and the Terms and Conditions.

What personal data we collect

We generally collect your personal data directly from you so that you have control over the type of information you provide to us. The data transmission to us is encrypted (HTTPS).

  • When you create an account in the Constanta PortALL application, send us: e-mail, name and surname, phone. This information is stored and will be used for authentication in the application. When the tickets are paid online, they will be sent to the payment processor.
  • Within the Profile page of the Constanta PortALL platform you can add additional information such as: company name, CUI company. This information is stored and will be used to bill tickets purchased at your request.
  • Within the Fleet page you can add additional information such as: The registration number of a vehicle. This information is stored and will be used by the LPR system for port access. They are also used to purchase tickets. When the tickets are paid online, they will be sent to the payment processor.
  • When purchasing port access tickets, the data mentioned above are sent to the online payment processor (encrypted HTTPS). The Constanta PortALL application redirects to the payment processor page. Bank card details are entered directly into the payment processor page / application. We do not store or process bank card information. These are received and managed entirely by the online payment processor.
  • We would like to inform you that whenever you use our service, in case of an error in the application, we collect and store data and information about the error that are transmitted to us automatically. This data includes information encapsulated in the Error javascript object such as Error.prototype.columnNumber, Error.prototype.fileName, Error.prototype.lineNumber, Error.prototype.message, Error.prototype.name, Error.prototype.stack. This information is used for system maintenance.
  • The application uses the Firebase Cloud Messaging service to send you notifications at the expiration of the port access term of a purchased ticket. For this purpose, after authentication in the application, the Firebase Cloud Messaging service will be queried and will generate a token associated with your device. This token is stored and used in the notification mechanism. When disconnecting from the application this token is deleted.

On our website ( https://www.portofconstantza.com ) we may store and collect information in cookies and similar technologies, according to the Cookies Policy. Constanta PortALL mobile application does not use cookies.

We do not collect or otherwise process sensitive data, included in the General Data Protection Regulation in special categories of personal data. We also do not want to collect or process data on minors under the age of 16.

What are the purposes and grounds of processing personal data

We will use your personal data to provide our services for your benefit.

This general purpose may include:

  1. Creation and administration of the account within the Constanta PortALL platform;
  2. Order processing, including taking over, validating, shipping and invoicing;
  3. Solving cancellations or problems of any kind related to an order, the goods or services purchased;
  4. Reimbursement of the value of the products according to the legal provisions;
  5. Providing support services, including providing answers to your questions about your orders or the goods and services offered in the application;

The processing of your data for these purposes is, in most cases, necessary for the conclusion and execution of a contract between CN APM SA Constanta and you. Also, some of the data we process is required by Romanian Fiscal Code and other aplicable legislation.

To protect our interests

There may be situations in which we use or transmit information to protect our rights and business. These may include:

  1. Measures to protect the website and users of the Constanta PORTALL platform against cyber attacks;
  2. Measures to prevent and detect fraud, including the transmission of data to other authorities;
  3. Measures to manage various other risks.

The general basis of these types of processing is our legitimate interest in defending our commercial activity. We will ensure that all the measures we take guarantee a balance between our interests and your fundamental rights and freedoms.

How long do we store your personal data

As a general rule, we will store your personal data as long as you have an account on the Constanta PORTALL platform. You may ask us to delete certain information or close your account at any time, and we will respond to such requests, subject to the retention of certain information, including after closing your account, where applicable law or our business interests so require.

To whom we transmit your personal data

If we have a legal obligation or if it is necessary to protect our legitimate interest, we may disclose certain personal data to public authorities.

We ensure that access to your data by third-party legal entities under private law is made in accordance with the legal provisions on data protection and confidentiality of information, based on contracts concluded with them.

We use the services of the LibraBank payment processor for our accepted payment method.

Despite the measures taken to protect your personal data, we warn you that the transmission of information via the Internet, in general, or through other public networks, is not completely secure, there is a risk that the data may be seen and used by unauthorized third parties. We cannot be held responsible for such vulnerabilities in systems that are beyond our control.

What your rights are

The General Data Protection Regulation gives you a number of rights in relation to your personal data. You may request access to your data, correct any errors in our files and / or object to the processing of your personal data. You may also exercise your right to complain to The National Supervisory Authority For Personal Data Processing or to go to court. Where applicable, you may also have the right to request the deletion of your personal data, the right to restrict the processing of your data and the right to data portability.

  • The right to rectification - refers to the correction, without undue delay, of inaccurate personal data.   • The right to delete data ("the right to be forgotten") - you can obtain the deletion of data, if their processing was not legal or in other cases provided by law;
  • The right to restrict the processing - you can request the restriction of the processing in case you dispute the accuracy of the data, as well as in other cases provided by law;
  • Right to oppose - represents the right to oppose, for reasons related to the particular situation you are in, the processing of personal data concerning you, including the creation of profiles based on those data, when the processing is carried out under Article 6 paragraph 1) letters e) and f), respectively for the achievement of a legitimate interest of the operator or for the accomplishment of a task that serves a public interest.
  • The right to data portability - you can receive, under certain conditions, the personal data you have provided us, in a format that can be read automatically or you can request that the data be transmitted to another operator;
  • The right to file a complaint - you can file a complaint regarding the way of processing personal data at the National Authority for the Supervision of Personal Data Processing;
  • Right of withdrawal of consent - in cases where the processing is based on your consent, you can withdraw it at any time. Withdrawal of consent will have effects only for the future, the processing performed prior to the withdrawal remaining valid;
  • Additional rights - related to automatic decisions: you can request and obtain human intervention regarding the respective processing, you can express your own point of view on this and you can challenge the decision

Complaints

Individuals have the right to file a complaint regarding the processing of their personal data. All questions and complaints will be processed by the DPO in a timely manner and in accordance with internal procedures.

In the unlikely event that the clients suffered damages due to the violation of the rights according to the personal data protection policy and CN APM SA Constanta did not handle the complaint properly, the clients have the possibility to send a complaint to the superior authority.

1. General conditions for using the Constanta PortALL application

CN APM SA created the Constanta PortALL application as a free application. The products and services described in this site are valid only for CN APM SA and are its exclusive property.

Constanta PortALL is an application for accessing vehicles in the port, at the control gates, equipped with barriers based on electronic tickets for access to the port.

In this sense, the mobile application allows the following functionalities for its users in their relationship with the activity of charging access in the area managed by CN APM SA:

  • buying short-term access tickets;
  • payment through a secure payment gateway;
  • activation of paid access tickets;
  • history of all purchase transactions;
  • the possibility to prove the validity of the entry by displaying the ticket / its QR code to a gate operator;
  • information about important events that would interest the regular mobile user;

2. Access to the information available on Constanta PortALL

CN APM SA offers all customers limited access, in personal interest and does not give them the right to partially or fully modify the application, to reproduce it in part or in full, to copy it, to sell / resell it or to exploit it in any way, for commercial purposes or contrary to the interests of CN APM SA.

Carrying out unauthorized operations on this service and attempts to perform them, including but not limited to: misuse, fraudulent use, unauthorized access, modification, copying of information for their use, blocking access, etc., will be considered attempts. of fraud and will determine the complaint / criminal investigation against the one who initiated this action.

3. Aspects regarding the protection of personal data

CN APM SA processes personal data, in accordance with the applicable legal provisions.

CN APM SA respects the rights that the applicable legislation in the field of personal data protection confers to the data subject, respectively the right to information, the right to access data, the right to rectification, the right to delete data ("the right to be forgotten"), the right to restrict the processing, the right to data portability, the right to oppose data processing, the right not to be subject to an automatic individual decision, the right to address the National Authority for Supervision of Personal Data Processing or competent courts, as well as the modalities for their exercise (In accordance with Regulation (EU) no. 679 of 27 April 2016 for the protection of individuals with regard to the processing of personal data and the free movement of such data, applicable from 25 May 2018).

CN APM SA processes personal data in conditions of legality, fairness and transparency, ensuring the integrity and confidentiality of personal data processed in accordance with applicable legal provisions and with the consent expressed by the data subject (in cases where necessary, according to legal provisions ). The personal information collected is used to provide and improve the service and will not be disclosed.

4. Collection and use of information

Client access to Constanta PortALL requires the creation of a user account. In order to achieve this, it is necessary to provide personal information (Name, surname, e-mail and telephone number). This information will be sent to the online payment operator when purchasing a ticket.

Only legal and natural persons who have the full capacity to conclude legal acts can be registered. In particular, the registration of minors is prohibited. The information that a client must provide during registration must be complete and correct.

Each customer can register only once. The user account is not transferable.

The requested information will be kept and used according to the measures assumed in the Privacy Policy - Constanta PortALL.

All documents and information of any kind provided by customers will be used only for the purpose of Constanta PortAll: payment of the ticket, verification of the validity of the ticket

5. Access to device functionalities

The application may require access to certain features of the device, such as:

  • Access to the storage device for caching the data provided by our service;
  • Internet access (either via mobile data or WI-FI) to communicate with our servers*;
  • Access to the camera, which can be revoked at any time**;

*Using mobile data may increase your billing cost based on your contract with your mobile operator.

**Checking a purchased ticket can be done by scanning a QR code, and in this case the application will require access to the camera.

6. Limitation of liability

The user uses the application at his own risk. In no case will CN APM SA be held responsible for direct or indirect damages and especially for material damage, loss of data or program, financial damage, resulting from access to or use of this site.

The content of the application is presented without any guarantee, of any nature. The information on their products, services and prices correspond to a definition at the time of their drafting or updating. Errors or omissions may occur.

These General Conditions, as well as any litigation in connection with or arising from the clauses of these General Conditions or from accessing / functioning / dysfunctionality of the service are subject to Romanian domestic law.

7. Payment and payment conditions

The customer can pay the tickets for access to the port through the Constanta PortALL application only if he has an active user account. Payment can be made using the bank card under the conditions:

  • The user is online, in order to pay for the tickets
  • The user is authenticated in the application
  • The user is on the "Buy ticket" page
  • The user has in the "Shopping Cart" list at least one access ticket for one of the vehicles in the list associated with his account.

If the payment process failed, the payment processor application returns an error message.

Adding the tickets in the shopping cart, in the absence of completing the order, does not entail their activation.

CN APM SA will cancel the order initiated by the client against any subsequent obligation of any party to the other or without any party claiming damages from the other party in the following cases:

  • non-acceptance of the transaction by the issuing bank of the card used by the user;
  • the data provided by the customer on Constanta PortALL are incomplete and / or incorrect

The invoice related to the placed order will be issued upon request based on the data provided by the customer, as they were entered when creating the account or as they were updated / modified in the specific section of Constanta PortALL.

CN APM SA is not responsible and cannot be responsible for the provision by the client of incorrect, incomplete and / or untrue data.

We recommend the clients to verify the data provided to CN APM SA, based on which the invoice related to the orders will be issued.

8. Other specifications

Tickets purchased through the application are valid until the end of the calendar year in which the purchase was made.

The value of purchased and unused / unactivated tickets is not returned

The ticket purchased for one vehicle is not transferable to another.
